Sale of Land – Laurentian Valley

The Township of Laurentian Valley has issued a Sale of Land by Public Tender.  Tenders are invited for the purchase of the land described as:

Part Lot 1 Concession 8 Alice designated Part 1 Plan 49R2174; Alice & Fraser. PIN 57117-0056(LT). Roll Number: 47 66 074 060 02705 0000. Minimum bid is $7,758.20.

The property is designated Rural in the Official Plan of the Township of Laurentian Valley and zoned Rural (RU) in Comprehensive Zoning By-law 08-04-321. There are some limitations to permitted uses listed in the RU zone as the property abuts lands zoned Extractive Industrial Reserve (EMR), Section 3.27(a)(iv) and (v) Separation Distances of the General Provisions of the Zoning By-law are applicable.

The EMR is the purple hatched area on the Zoning map excerpt. Any new dwelling is required to be a minimum of 150 metres of the EMR or in situations where that is not possible due to the size of the lot, that can be reduced to 60 metres. However, as the lot depths for this lot range between approximately 51 and 52.5 metres, it would not be possible to meet a 60 metre setback from the EMR. So with this lot if the proposed use is not one of the other permitted RU uses, and a residential dwelling is proposed, a zoning by-law amendment would be required to be approved to reduce the minimum setback from EMR and this is a public process under the Planning Act.

The tenders will then be opened in public on the same day as soon as possible after 3:00 p.m. at the Laurentian Valley Municipal Office, 460 Witt Road, Pembroke.

Tenders must be submitted in the prescribed form and must be accompanied by a deposit in the form of a money order or of a bank draft or cheque certified by a bank or trust corporation payable to the municipality and representing at least 20 per cent of the tender amount.

Except as follows, the municipality makes no representation regarding the title to or any other matters relating to the land to be sold.  Responsibility for ascertaining these matters rests with the potential purchasers.

This sale is governed by the Municipal Act, 2001 and the Municipal Tax Sales Rules made under that Act.  The successful purchaser will be required to pay the amount tendered plus accumulated taxes, HST if applicable and the relevant land transfer tax.

The municipality has no obligation to provide vacant possession to the successful purchaser.
